The obligation of the Mexican State to protect the intangible heritage of indigenous people is typified in the Constitution; however, unfair practices such as piracy among others, cause violations of its moral and economic rights. The present study is designed by a documentary investigation of the current regulations within the local, national, and international treaties, also byan analytical method of the main legal normswhich impinge in thetopic. Thefindings show the urgency of modify the lawof indigenous culture of the stateasguarantor response to effective protection of knowledge and expressions of ethnic groups in Nayarit, it is agreed the establishment or restructuring local institutions that fully comply the function to protect the indigenous intellectual property. |
