Uma contribuição jusprivatista ao estudo do patrimônio cultural imaterial: a proteção das «fallas» valencianas pelo direito autoral

This article reflects on the valuation through private law of works coming from intangible cultural heritage. Traditionally, the law provides normative solutions of public law for the conservation and dynamization of intangible assets. This contribution underlines the importance of certain tools of private law, namely copyright, for the protection of intangible cultural heritage. To illustrate this idea, it studies the recent recognition by UNESCO of the festival of the Valencian Fallas as Intangible Heritage of Humanity and its relation with copyright.
